Welcome to Yamuno Software. These Terms of Service ("Terms") govern your access to and use of Yamuno Software's applications, services, and websites (collectively, the "Services"). Please read these Terms carefully before using our Services.

1. Agreement to Terms

By accessing or using our Services, you agree to be bound by these Terms, our Privacy Policy, and our End User License Agreement (EULA). Our EULA incorporates the Bonterms Standard End User Agreement (v1.0) along with Yamuno-specific terms. If you do not agree to these Terms, do not use our Services.


2. Services Description

Yamuno provides Cloud Apps that integrate with Atlassian Cloud Products (including Jira and Confluence). Our Services are designed to enhance and extend the functionality of these platforms while maintaining high standards of security and performance.

Our apps are distributed through the Atlassian Marketplace and operate entirely within Atlassian's Forge platform. You do not need a separate Yamuno account to use our apps — authentication and access are managed through your existing Atlassian identity.


3. Authorized Use

3.1 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to:

  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Services or servers
  • Attempt to gain unauthorized access to any part of the Services
  • Use the Services for any harmful, malicious, or fraudulent purpose
  • Circumvent or disable any security or access control features

3.2 Content Standards

Any content you submit or share through our Services must:

  • Be accurate and not misleading
  • Respect the intellectual property rights of others
  • Not contain malicious code or harmful components
  • Comply with all applicable laws and regulations

3.3 Authorized Users

You are responsible for ensuring that all users within your organization who access the Services do so in accordance with these Terms. You are liable for any breach of these Terms by your authorized users.


4. Payment Terms

4.1 Payment Processing

All payments, billing, and subscription management are handled directly by Atlassian in accordance with the Atlassian Marketplace Terms of Use and Atlassian Privacy Policy.

Yamuno does not directly process, store, or have access to payment information. All payment-related inquiries should be directed to Atlassian.

4.2 Fees and Billing

  • Fees are as specified in your subscription plan on the Atlassian Marketplace
  • All payments are subject to Atlassian's refund policies
  • Fee changes will be communicated through the Atlassian Marketplace platform

4.3 Subscription Terms

  • Subscriptions are managed through the Atlassian Marketplace
  • Subscription renewals and cancellations are handled by Atlassian
  • Refund policies are governed by Atlassian terms

5. Service Availability and Support

5.1 Service Availability

  • Our apps run within Atlassian's Forge infrastructure. Availability is dependent in part on Atlassian's platform uptime.
  • We strive to maintain high availability and minimize disruptions caused by our code.
  • Planned maintenance or updates will be communicated in advance where possible.

5.2 Technical Support

Support is provided through our designated channels with the following response targets:

P1 — Critical App unusable, blocking business operations 1 business day
P2 — High Major feature broken, workaround unavailable 2 business days
P3 — Normal Feature issue, workaround available 5 business days
P4 — Low General questions, minor issues 7 business days

6. Data Handling and Privacy

6.1 Data Processing

We handle your data in accordance with our Privacy Policy. By using our Services, you agree to our data processing practices as described therein.

6.2 Data Security

We implement industry-standard security measures to protect your data, as detailed in our Security Policy and Privacy Policy. All app data remains within Atlassian's infrastructure.

6.3 Data Processing Agreement

Enterprise customers requiring a Data Processing Agreement (DPA) for GDPR compliance may request one by contacting [email protected].


7. Intellectual Property Rights

7.1 Our Rights

  • We retain all rights to our Services, including software, designs, and content
  • Our trademarks and brand features are protected by law
  • You may not use our intellectual property without prior written permission

7.2 Your Rights

  • You retain all rights to your content and data
  • You grant us only the licenses necessary to provide the Services
  • We respect your intellectual property rights

8. Termination

8.1 Termination by You

  • You may terminate these Terms by discontinuing use of our Services
  • You must cancel your subscription through the Atlassian Marketplace to stop billing

8.2 Termination by Us

  • We may terminate or suspend your access for material violations of these Terms
  • We may discontinue Services with reasonable advance notice
  • We are not liable for any loss resulting from termination in accordance with these Terms

9. Limitation of Liability

Limitation of liability is governed by the terms set forth in our EULA, which incorporates the Bonterms Standard End User Agreement. In summary:

  • Yamuno's total liability shall not exceed the fees paid for the applicable Yamuno app in the twelve (12) months preceding the claim
  • Neither party shall be liable for indirect, incidental, consequential, punitive, or special damages
  • Enhanced liability caps apply to security breaches as specified in the Bonterms agreement

10. Force Majeure

Yamuno shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, internet or telecommunications failures, government actions, or failures of third-party platforms including Atlassian's infrastructure.


11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes shall be resolved in accordance with the dispute resolution process set out in our EULA.


12. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms continue in full force and effect.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through:

  • Email notification (where available)
  • Service announcements
  • Website updates

Material changes will take effect no sooner than 30 days after notice. Continued use of our Services after changes constitutes acceptance of the modified Terms.
